The Netherlands and Germany

Where it is already law

Two European jurisdictions have independently written the two halves of this framework into law and practice — the binding green standard, and the proven neurodivergent workforce pipeline. Neither was copying the other. Each arrived at the same pairing on its own, which is precisely why the pairing should be taken seriously.

Germany pairs the strictest green data-center law in Europe with the company that invented the neurodivergent-IT employment model.

The law. The Energy Efficiency Act (EnEfG, in force November 2023) imposes a power usage effectiveness (PUE) ceiling of 1.2 for new data centers from July 2026, staged waste-heat reuse requirements (10% → 15% → 20%), 100% renewable electricity from 2027, and mandatory public efficiency-register reporting.

The firm. auticon — founded in Berlin in 2011 — is the world's first company built exclusively around autistic IT consultants. By its 2024 impact report (company-reported): 552 employees across 15 countries, 79% neurodivergent, 405 autistic people in technology and data roles, and 307 clients including BMW and Allianz. Nine in ten of its autistic hires were unemployed before joining.

The Netherlands codifies the strongest "community benefit" test for data center existence in Europe, alongside one of the continent's most mature neurodivergent employment pipelines.

The test. Amsterdam operates on an explicit "no, unless" basis — new data centers are refused unless they both benefit Amsterdam and cause no additional grid congestion. After a 2019 moratorium and December 2023 restrictions, the city extended its moratorium until 2035, and hyperscale projects of 70 MW or more are banned in most of the country. Community benefit is already a legal test for a data center's right to exist.

The pipeline. ITvitae (founded 2013) is a registered social enterprise training and placing gifted autistic ICT specialists through roughly nine-month programs, with partners including Sogeti and Northwave. Its motivating numbers, by the organization's own reporting: 54% of autistic people with higher IQs are unemployed in the Netherlands — more than 20,000 unemployed autistic talents at university level or above. The 2023 auticon–Unicus merger created the world's largest autistic-majority company, operating across 15 countries.

The Dutch Data Center Association's own labor-market study quantifies the demand this pipeline serves: direct data-center employment grows roughly 8% annually, from about 5,000 (2021) to more than 7,100 (2026), with over 600 open vacancies — and 70% of operators cited personnel shortage in 2024.

Germany legislated the green standard; the Netherlands legislated the community-benefit test. Both built the neurodivergent pipeline. Two independent legislatures, two independent workforces, one convergent conclusion: this pairing is not a proposal. Its legal half is already law in two places, and its workforce half is already at work.
